Terms and Conditions

Introduction 

DSquared Reptiles ("we," "us," or "our") operates dsquaredreptiles.com (the "Site") to provide information about our ethical breeding practices, showcase panther chameleons, and facilitate inquiries and sales. By using the Site, you ("you" or "Customer") agree to these Terms and Conditions ("Terms"), forming a binding contract. These Terms apply to all users, including visitors, inquirers, and buyers. If you do not agree, please do not use the Site. We may update these Terms at any time; continued use means you accept changes.  


Services and Availability  

- We offer Site content, including chameleon descriptions, breeding information, and contact forms for appointments or purchases.  

- Sales are limited to in-person pickups at our California facility or approved shipping compliant with USDA and state regulations.  

- We may withdraw or cancel services (e.g., hold shipments during extreme weather) at our discretion, with notice where possible.  

- Transactions are subject to availability and our approval.  


Purchases and Payments  

- Purchases require prior approval via phone (818-530-3707) or in-person appointment.  

- Prices are listed but may change. Payments are accepted via cash, credit card, or electronic transfer; all sales are final upon animal handover or shipment.  

- Shipping fees apply for interstate deliveries, compliant with California’s nonfood animal sales tax rules (seller’s permit required for more than two animals sold annually).  

- You agree to provide accurate shipping details; we are not liable for delays due to incorrect information.  


Warranties and Guarantees 

- Live Arrival Guarantee: If a shipped chameleon arrives deceased due to transit issues, notify us within 24 hours with photos. We will replace it or issue a refund (less shipping costs) at our discretion.  

- No health warranty is provided beyond arrival, as reptile well-being depends on your care (e.g., enclosure setup, temperature, diet).  

- Animals are sold "as is," captive-bred in-house under ethical standards. You assume full responsibility upon receipt.  

- Returns are not accepted except in DOA (dead on arrival) cases.  


Liability and Disclaimers

- We strive for accurate Site information but are not liable for errors, downtime, or interruptions.  

- Animals are sold "as is"; we are not responsible for outcomes due to negligence, improper care, or failure to research local laws (e.g., exotic pet permits).  

- Our liability is limited to the purchase price. We are not liable for indirect damages, such as vet bills.  

- The Site is provided "as available," without warranties of merchantability or fitness for a particular purpose.  


Intellectual Property 

- Site content (photos, breeding details, logos) is owned by DSquared Reptiles or licensed to us.  

- You may view content for personal, non-commercial use. Reproduction, adaptation, or distribution without attribution is prohibited.  

- Commercial use requires written permission. User-submitted content (e.g., inquiry photos) grants us a non-exclusive license for promotional use.  


User Conduct and Prohibitions 

- You agree to use the Site lawfully and ethically. Prohibited actions include:  

  - Submitting false information or spamming inquiries.  

  - Promoting illegal breeding or animal neglect.  

  - Engaging in hate speech, bullying, or harassment (e.g., discriminatory comments about care practices).  

- You must comply with federal (e.g., AWA retail exemptions) and state laws (e.g., no street sales per CA Penal Code § 597.4).  

- Misuse may lead to us reporting unlawful behavior or suspending access.  


Account Termination  

- We may disable or terminate your access for violating these Terms, suspected fraud, or non-payment.  

- Upon termination, you must cease Site use and return any undelivered animals if applicable.  


Governing Law and Dispute Resolution  

- These Terms are governed by California law, without regard to conflict principles.  

- Disputes shall be resolved in Los Angeles County courts.  

- You agree to indemnify us against claims from your Site or animal use (e.g., injury from improper handling).

Additional Protections  

- Ethical Breeding: All chameleons are raised with world-class care; resale for unethical purposes (e.g., neglect) is prohibited.

Return and Refund Policy

Introduction  

At DSquared Reptiles, we are committed to delivering healthy, ethically bred panther chameleons to our customers. Due to the unique nature of live animal sales, our Return and Refund Policy is designed to ensure clarity and fairness while prioritizing animal welfare. This policy outlines the conditions under which returns or refunds may be requested, the process for initiating them, and how we handle such requests. By purchasing from dsquaredreptiles.com (the "Site") or in-person at our California facility, you agree to this policy.  


Terms of Return  

- Live Animals: Returns are only accepted for chameleons that arrive deceased (Dead on Arrival, or DOA) during shipping. You must notify us within 24 hours of delivery to initiate a return.  

- Time Limit: No returns are accepted beyond 24 hours after delivery or pickup, as animal health depends on your care post-delivery.  

- Non-Returnable Items: No returns are accepted for live animals after the 24-hour DOA period, as we cannot guarantee post-delivery care (e.g., enclosure setup, diet). Non-animal products (if offered, e.g., enclosures) may be returned within **7 days** if unopened and unused.  


State of Return  

- Live Animals: For DOA claims, the chameleon must be returned in the same condition as delivered, with no signs of mishandling (e.g., improper temperature exposure). You must provide photographic evidence of the deceased animal.  

- Non-Animal Products: Must be unopened, unused, and in original packaging with all tags or labels intact.  


Reason for Return  

- Valid Reasons:  

  - DOA for Shipped Animals: Chameleon arrives deceased due to transit issues (e.g., carrier delays).  

  - Wrong Product: You receive an incorrect non-animal item (if applicable, e.g., wrong enclosure model).  

  - Damaged Product: Non-animal items arrive damaged (e.g., cracked enclosure).  

- Invalid Reasons: Returns are not accepted for reasons such as buyer remorse, failure to research care requirements, or non-compliance with local exotic pet laws.  


Process for Return 

1. Initiate a Return: Contact us within 24 hours for DOA claims or 7 days for non-animal products via:

4. Inspection: Returned items are inspected upon receipt. For DOA claims, we verify transit-related issues.  


Process of Refund  

- Eligibility: Refunds are issued for:  

  - Approved DOA claims (less shipping costs).  

  - Damaged or incorrect non-animal products (full refund, including shipping if we are at fault).  

- Refund Method: Refunds are issued to the original payment method (e.g., credit card, electronic transfer). Cash refunds for in-person purchases are at our discretion.  

- Duration: Refunds are processed within **7 business days** of receiving and approving the return. Allow additional time for bank processing.  

- Non-Refundable: Shipping fees for live animals are non-refundable unless we fail to deliver. No refunds are issued for live animals after the 24-hour DOA period due to care variability.
